CCC Plus Waiver Personal Care for Individuals under 21 No Longer Under EPSDT

GREAT NEWS!   DMAS HAS HEARD ALL OF YOU WHO HAVE BEEN STRUGGLING WITH THE EPSDT PERSONAL CARE CHANGE!

Last year, Medicaid CCC Plus Waiver Personal Care for people under the age of 21 was changed. The change required new forms and a new process for authorizing Personal Care using standards for Early and Periodic Screening, Diagnosis and Treatment (EPSDT). It required the child’s doctor to fill out the DMAS-7 form and left no room for error.  The changes were confusing and resulted in some young people experiencing a lapse in Personal Care services while waiting on the form and/or receiving fewer hours of Personal Care than they had in the past. 

The Virginia Department of Medical Assistance Services (DMAS) has worked with the federal Centers for Medicare and Medicaid Services (CMS) to reverse the change that was made last year. The new changes will be effective May 1 for people under the age of 21 who use the CCC Plus Waiver.  Effective May 1, Personal Care hours for those under 21 who are on the CCC Plus Waiver will no longer go through Early and Periodic Screening, Diagnosis and Treatment (EPSDT)! 

What does this mean for those under 21 on the CCC Plus Waiver?  It means you will no longer be required to get the DMAS-7 form filled out and signed by the doctor in order to get an authorization for Personal Care hours.  Instead, your Service Facilitator will be able to do a plan of care which does not necessarily require input from your doctor (unless certain supervision tasks are needed), just like they used to prior to the EPSDT change on September 1, 2018.  This is great news for all involved!!!  

For the time being, individuals with the Community Living (CL) or Family and Individual Supports (FIS) Waivers will continue to get the Personal Care authorizations through EPSDT.  Also, those on straight EPSDT that do not have a waiver will continue to need the DMAS-7 filled out by the doctor in order to get an authorization for Personal Care hours.  Also those with the CCC Plus Waiver that receive Personal Care hours in school, these Personal Hours will also be through EPSDT.

A few Q’s & A’s.  Only applies to those under 21 with a CCC Plus Waiver:

Q:  So is EPSDT totally gone?
A:  No, for those on the Community Living (CL) Waiver, Family & Individual Supports (FIS) Waiver, and for those with Medicaid under 21 getting Personal Care through EPSDT and not on a waiver, EPSDT will continue to exist.  Also, for those under 21 with a CCC Plus Waiver who are getting Personal Care hours in school, those specific hours will still be requested through EPSDT.  For all of these individuals, Personal Care hours authorization will continue to require a DMAS-7 from the doctor.

Q: What if my authorization for Personal Care ends on 4/29/19?  My new authorization will start on 4/30/19, so do I need a DMAS-7 from my doctor?
A:  You, will still be required to get a DMAS-7 form from your doctor up to and through 4/30/19 as this request will still have to go through EPSDT.

Q:  What if my authorization for Personal Care ends on 4/30/19?  My new authorization will start on 5/1/19, so do I need to get the DMAS-7 from my doctor?
A:  No, your Service Facilitator will write your plan of care using their own assessment and visit data.  This will still require the Employer of Record to review and sign the plan of care.

Q: What if my Personal Care hours were reduced when I submitted the DMAS-7 form?  Do I get those hours back now?
A:  No, not necessarily.  In cases where there is a clear justification for requesting an increase in hours, a new request for authorization can be done to try to get that increase.  Please work with your Care Coordinator and Service Facilitator if you think this applies to you.  Also, there is no guarantee that a new request with an increase will be approved or that you will get back all of the hours you had prior to the change.

Q: What if I made the decision to just use Respite hours instead of dealing with the DMAS-7?  Can I now get Personal Care hours back without getting my doctor involved?
A:  Yes!  On and after May 1, 2019, you will no longer be required to get the DMAS-7 form filled out by your doctor in order to get Personal Care hours.  Simply contact your Service Facilitator and schedule a visit if you haven’t had a recent one.  Again, this will be a new request and does not guarantee you will get the same number of hours you had prior to the change.

Q: What if my Personal Care hours lapsed while I was trying to get the DMAS-7 from my doctor, will I be able to get my authorization back dated to cover that gap now?
A: Unfortunately, no.  An authorization for hours starts the day it is submitted to the approving organization (MCO’s) and unfortunately cannot be backdated.  If there is no authorization in place, Personal Care aides should not be working.

Q: Does this change mean that I cannot get more than 35 hours per week of Personal Care?
A: No it does not.  In cases where there is a clear reason and thorough justification for more than 35 hours, a request can be made for more.  Again, there is no guarantee that a request for more than 35 hours will be approved for more than 35 hours.  

Please note:  In an effort to get authorizations in place for those of you that are affected by this change and who are our Moms In Motion clients, we may need some information from you.  In order to protect your personal health information, we will likely ask for that information via secure email.  It will come from Zixmail.  Often, these emails go to spam.  If your Service Facilitator tells you that they are sending you a secure email, please be on the lookout for it and respond to it quickly as it may impact your re-authorization for Personal Care hours.

If you are on the CCC Plus Waiver, did you know that you could also be on the waiting list for one of the three DD Waivers (Building Independence, Family and Individual Supports or Community Living)?  How to apply for the FIS or CL Waiver.

Review Mobility and Behavior/Orientation levels as noted on our reports. – Are they accurately reflecting your reality?

Which of the three Fiscal Agents are you using?
2. At every visit:
Are you enrolled in CCC Plus (Commonwealth Coordinated Care Plus) Waiver?
If so, which Managed Care Organization (MCO) are you currently using? Let us know if it changes!
Is your child/are you on HIPP for Kids/HIPP?
Who is the Employee of Record (EOR)? Is that accurately reflected in your Fiscal Agent’s portal?
Changes: Any medical and/or functional changes since our last visit? Any recent hospitalizations? Who is your current Primary Care Physician (PCP)?
Who are your attendants and are they getting paid? Do you have a back-up caregiver? A back-up caregiver can not be the Primary Care Giver (PCG) or the Employer of Record (EOR).

Facts about The CCC Plus Wavier
The CCC Plus Waiver is a Medicaid program for elderly and individuals with disabilities to receive services in their homes and communities. These services can be consumer directed. Moms In Motion can be your Service Facilitator for consumer direct services. You are able to choose your attendant with consumer directed services. Read Moms In Motion’s CCC Plus Waiver Resource Page. Contact any one of Moms In Motion’s Family Resource Specialists to get your Waiver process started. They can guide you though the application process.  

View what services and funding are covered by the CCC Plus Waiver.   To request a screening to determine eligibility for a CCC Plus Waiver, contact your local Department of Social Services (DSS) (adults) or Department of Health (DOH) (kids).

Assessments are completed by representatives of the Heath Department and Social Services to determine if the individual is at risk of Nursing Home placement. If an individual meets that determination they most likely qualify for a CCC Plus Waiver.

You can not be denied a screening.

Screenings can take place when the individual is hospitalized. You do notneed Medicaid to be screened.
Personal Care is Now Under EPSDT for Individuals Under 21  
In a Medicaid Bulletin it states that starting September 1, 2018, individuals under the age of 21 that are enrolled in the CCC Plus Waiver, must receive personal care, private duty nursing, and assistive technology through the Early Periodic Screening and Diagnostic Treatment (EPSDT)benefit. This change is being made to comply with the Centers for Medicare and Medicaid Services’ (CMS) requirement that certain Medicaid funded services for individuals under the age of 21 be accessed through the EPSDT benefi in lieu of a 1915 (c) Home and Community Based Services waiver.

Since Personal Care has been moved under EPSDT (a Medicaid program not a Waiver), that will no longer be a Waiver service.  Because of this, you will need to have at least one other service in addition to EPSDT personal care hours. Respite meets that requirement for most, but if you do not receive respite hours you will need to make sure you are using another waiver service.

Adult Day Health Care
Assistive Technology
Environmental Modifications
Medication Monitoring
Personal Emergency Response System (PERS)
Private Duty Nursing Services
Respite Care
Skilled and Intermediate (custodial) nursing facility or long stay hospital Transition Services (moving into the community and out of a nursing facility)

Tips/Notes: 
Unfortunately, Moms In Motion cannot complete the DMAS-7. Therefore it falls to you to make sure the DMAS-7 is complete, correct and received on time to your Moms In Motion Service Facilitator.  

We have noticed that hours are being reduced in general.  While we are the ones that submit the doctor’s documentation for you, please note that Moms In Motion does not have control over how many hours get approved.  It is up to the authorizing agency (DMAS, DBHDS, and/or one of the 6 MCO’s) to approve Personal Care Attendant hours.      

In order to prevent a lapse or delay in service, please discuss your authorization renewal dates with your Service Facilitator to figure out when it makes sense to start talking to your doctor about this document.

A specialist cannot complete the DMAS-7, it needs to be filled out by a pediatrician, developmental pediatrician, or a primary care physician. 

It is important that the doctor fills out the form properly! HERE IS A SAMPLE DMAS-7that is already filled out that you can show to your doctor to guide them. If you already have an authorization in place for Respite, you can use your respite hours until your personal care hours are authorized in order to bridge any sort of gap. 

Without the DMAS-7 from the doctor there may be a delay in approval of authorizations and/or attendants may not be paid on time. It is important for parents to advocate to their doctor what supports their child needs, so no attendant hours are lost. 

Authorizing entities (MCO’s, KePRO, DBHDS) make the final decision on hours approved. These requests are scrutinized each time they are submitted and a previous approval of X amount of  Personal Care hours is not a guarantee to have the same hours regardless of the what the doctor puts on the DMAS-7.  

If your Personal Care services are denied or reduced and you disagree, please consider filing an appeal. If denials and reductions are happening frequently and there are no appeals, Department of Medical Assistance Services (DMAS) will not know the magnitude of the problem. Each managed care plan (MCO) has their own internal process to follow before filing an appeal with DMAS. When you were provided written notice about the reduction or denial of services, you should have received written directions about how to file an appeal. You can also contact your managed care plan for details about their appeal process. MCO contact information.

If your request for reconsideration of the reduction or denial is not successful with the managed care plan, you can still file an appeal directly to DMAS. DMAS appeal process information.

Even before you file an appeal, you can contact the Office of the State Long-Term Care Ombudsman for advocacy support. They have a contract with DMAS to provide advocacy assistance to people of all ages who are having problems getting services from their CCC Plus managed care plan.

Medicaid Member Advisory Committee Are you a Medicaid member or does a member of your family have Medicaid coverage? Do you have ideas about how to improve the program to better serve you and your family and others?

The Virginia Department of Medical Assistance Services (DMAS) is seeking participants for a new Medicaid Member Advisory Committee. This advisory committee will be made up entirely of Virginia Medicaid members, family members or other representatives and they will play a key role in the review of new and existing health policies and services, making recommendations to the DMAS Director.

Fiscal Agents (Attendant Payroll) One MCO (Magellan) and FFS Waivers have switched fiscal agents for the Medicaid waiver-funded Home and Community Based Services (HCBS) programs. Fiscal agents manage payroll and taxes for Personal Care Attendants.  

It’s important for you to know which fiscal agent you use. Please make sure your Moms In Motion Service Facilitator knows which fiscal agent you are using. The three have differences and it’s important you know which one you need to be registered with so your attendants will be paid on time.

Tips:
Your back-up caregiver can not be the Primary Care Giver (PCG) or the Employer of Record (EOR). You may choose a family member, neighbor, friend, or paid employee willing and available to assist the individual when needed. Your Service Facilitator or Case Manager or Support Coordinator may not be the back-up person. A back-up caregiver is someone who is NOT the Primary Care Giver (PCG) and NOT the attendant. A backup caregiver is the secondary person who will assume the role of providing direct care to and support of the waiver individual in instances of emergencies and in the absence of the Primary Care Giver (PCG) who is unable to care for the individual. Failure to identify a back-up person/caregiver could result in termination of services.

Please give your Moms In Motion Service Facilitator the name of your back-up caregiver.
Attendants can not start working until authorizations are approved. Ask your Moms In Motion Service Facilitator the start date for time sheets.

How the Changes to EPSDT are Impacting Families
An eye opening news article was published about changes to the EPSDT Program which impacts children with disabilities in Virginia. Many parents have been scrambling to comply with new regulations that leave their children at risk due to cuts their Personal Care Services.

Quote from the article, published by The Free Lance-Star in Fredericksburg, Virginia on March 16, 2019:

“Yet as a result of recent changes, the amount of time Medicaid will pay attendants to help with her care has dropped from 80 hours to 49 hours a week. Similar reductions are happening statewide as the Virginia Department of Medical Assistance Services, which administers Medicaid, tries to cut costs.”

Virginia Mental Health Access Program
The Virginia Mental Health Access Program (VMAP) will help close the gap in care for the children and adolescents in our state who are without access to the best mental health services.

VMAP has received three separate grants and has partners and supporters throughout the state committed to helping children get the treatment they need. The program is already providing services in some regions. The $1.23 million allocated in the Governor’s budget will get VMAP off the ground and enable it to fully expand statewide.

Waivers
Personal Care is Now Under EPSDT for Individuals Under 21

In a Medicaid Bulletin it states that starting September 1, 2018, individuals under the age of 21 that are enrolled in the CCC Plus Waiver, must receive personal care, private duty nursing, and assistive technology through the Early Periodic Screening and Diagnostic Treatment (EPSDT)benefit. This change is being made to comply with the Centers for Medicare and Medicaid Services’ (CMS) requirement that certain Medicaid funded services for individuals under the age of 21 be accessed through the EPSDT benefit in lieu of a 1915 (c) Home and Community Based Services waiver.

Since Personal Care has been moved under EPSDT (a Medicaid program, not a Waiver), that will no longer be a Waiver service.  Because of this, you will need to have at least one other service in addition to EPSDT personal care hours. Respite meets that requirement for most, but if you do not receive respite hours you will need to make sure you are using another waiver service.

Environmental Modifications
Medication Monitoring
Personal Emergency Response System (PERS)
Private Duty Nursing Services
Respite Care

Tips/Notes: 

Unfortunately, Moms cannot complete the DMAS-7 ourselves 🙁 Therefore it falls to you to make sure the DMAS-7 is complete, correct & received on time by your Moms In Motion Service Facilitator.  In order to prevent a lapse or delay in service, please discuss your authorization renewal dates with your Service Facilitator to figure out when it makes sense to start talking to your doctor about this document.

A specialist cannot complete the DMAS-7, it needs to be filled out by a pediatrician, developmental pediatrician, or a primary care physician. 
It is important that the doctor fills out the form properly! HERE IS A SAMPLE DMAS-7 that is already filled out that you can show to your doctor to guide them. If you already have an authorization in place for Respite, you can use your respite hours until your personal care hours are authorized in order to bridge any sort of gap. 

Without the DMAS-7 from the doctor there may be a delay in approval of authorizations and/or attendants may not be paid on time. It is important for parents to advocate to their doctor what supports their child needs, so no attendant hours are lost. 

Authorizing entities (MCO’s, KePRO, DBHDS) make the final decision on hours approved. These requests are scrutinized each time they are submitted and a previous approval of X amount of  Personal Care hours is not a guarantee to have the same hours regardless of the what the doctor puts on the DMAS-7.

Latest News on the IFSP (Individual and Family Support Program)

The Individual and Family Support Program (IFSP) is designed to assist individuals on the DD Waiver wait list and their families to access short-term, person/family centered resources, supports and services. These services and items funded through the IFSP are intended to support the continued residence of an individual in their own or family home in the community.

If your wait list status changes before you receive additional notifications from the IFSP (for example: you receive a waiver, you leave the wait list, or you move out of state), please send IFSP your updated information using the following link: https://www.surveymonkey.com/r/ifspchangeform.
Note: This form will only accept information updates. Please do not use it to send messages or questions to the IFSP Program.

IFSP staff have completed their initial review of FY 2019 application requests and have begun issuing funds to approved FY 2019 applicants. This year they received almost 4,500 requests for assistance. At this time with the available monies, they are able to fund 3,028 applicants who met all of the IFSP criteria.

Before you use your Way2Go Card, there are a few things IFSP staff would like for you to know:

Look carefully and do not throw away any of your mail! For security purposes, the letter and card will arrive in an unmarked plain envelope with a return address from Austin, TX.

All cards will be mailed directly to the address that was provided for the Responsible Party when the application was completed. If you need to change your address, please contact IFSP staff using the Address Change Form: https://www.surveymonkey.com/r/ifspchangeform.

Do not make any purchases with the card until January 21, 2019. IFSP Staff will not accept any receipts for purchases made before 1/21/19. Instructions for submitting receipts will be sent out January 22, 2019 via email. You must submit receipts. 

Each Responsible Party will receive one pre-loaded Way2Go Card within 5-10 business days of receiving the announcement email. The card will include the total award amount that was approved for all of the Responsible Party’s applications.

You will need to authorize your card before you can use it. You can authorize your card by downloading the mobile app, visiting the www.goprogram.com website, or calling 800- 961-8423. Additional instruction on how to authorize and use the card will be sent via email to the Responsible Party.

If you have not received the Way2Go Card by January 31st, please contact Conduent, the card vendor, by calling their customer service line: 800-961-8423.

The Virginia Lifespan Respite Voucher Program

The Virginia Lifespan Respite Voucher Program (VLRVP) provides reimbursement vouchers to Virginia caregivers who reside full-time, in the same household as the person receiving care, for the cost of temporary, short-term respite care provided to individuals, of any age, with a diagnosis of dementia and for grandparents or relative caregivers providing care to a child not more than 18 years of age or an individual 19 to 59 years of age who has a severe disability. 

Priority will be given to assist those caregivers with the greatest social and economic need. Respite funding is limited to $400.00 per family through July 31, 2021 or until funds are exhausted. Funds may NOT be used to reimburse household expenses or daycare (to go to work or other daycare). Due to limited funds, not all eligible applications will be approved. 
The Partners in Policymaking Program

The Virginia Board for People with Disabilities (VBPD) are now accepting applications for the 2019-2020 Partners in Policymaking program. Applications are due by March 15, 2019 by 5pm. Class begins September 13, 2019.

The 2019-2020 session of Partners in Policymaking begins September 13, 2019, and runs through April 4, 2020, across seven two-day sessions in the Richmond area. Applications are accepted from individuals with developmental disabilities or parents of children with developmental disabilities. VBPD covers all expenses for participants’ training, lodging, meals, and travel.

The group of selected participants, consisting of parents and self-advocates, will build networks with state and national leaders as well as one another. Receive hands-on instruction from experts and thought leaders from around the country to make you the best you can be. Have an impact, and become a Partner in Policymaking! Participants will be educated on best practices and current trends in many areas including:

The Empowering Life Story of a Partners in Policymaking Graduate


Rob is a 35-year survivor of a spinal cord injury that resulted in him becoming a quadriplegic at the age of 17-years-old.  In 2005, Rob developed an infection, which led to the loss of his independence. He had to give up his apartment to live in an institution / nursing home. He had several medical complications following this infection, which led Rob to becoming homeless with nowhere to turn for assistance. With no other alternatives, Rob had to agree to being housed in several different nursing homes in the Tidewater area.

There, at the nursing home his restless researching led him to his second lease on life. He discovered the Money Follows the Person Program (MFP), and Partners in Policymaking. He found funding to purchase his first wheelchair-accessible van with the help of a loan through Virginia’s Assistive Technology Loan Fund Authority. Soon after, Rob found his way to college! With the assistance from the Department for Aging and Rehabilitative Service (DARS), he now has a Bachelor of Science degree. His goal is to help individuals and family members affected by substance abuse and/or homelessness in the Human Services field.

Due to his age at the onset of his disability, he received a Developmental Disability Waiver in 2009. Some of the many benefits Rob has experienced due to his DD Waiver are being his own Employer of Record and hiring his own attendants as well as obtaining Assistive Technology and Environmental Modifications

Charitable Fund Award

Established in 2009 to support Commonwealth Community Trust‘s mission of helping people with special needs improve their quality of life, this grant program/award offers assistance with the purchase of equipment, medication or services to Virginia residents who demonstrate a financial need.

The recipient must live in Virginia and have a disability that meets the SSA definition of being disabled. Disability for adults is defined as the inability to engage in “substantial gainful activity.” There must be a physical or mental impairment that can be expected to last at least 1 year. A child must have a physical or mental condition that very seriously limits his or her activities and is expected to last at least 1 year. The recipient must meet Federal poverty guidelines and/or receives SSI benefits.Online application period opened January 14, 2019 and will close March 28, 2019.For 2019, the maximum amount per recipient will be $1,000.

You can post questions and network with others and learn their experiences about the devices that work the best. Ability Unlimited’s team members are monitoring posts and will be available to answer questions in the group.

Ability Unlimited can help by submitting requests to provide access to devices available for people with a wide range of disabilities, including those who have sensory, vision and mobility issues. Ability Unlimited provides AT, EM, DME to people with special needs who have Virginia Medicaid either through a waiver or that qualify for EPSDT (VA Medicaid + under the age of 21). Ability Unlimited can also provide devices, etc through private funding means.

Resources for Tax Season
The Earned Income Tax Credit (EITC) This is a benefit for working people with low to moderate income. To qualify, you must meet certain requirements and file a tax return, even if you do not owe any tax or are not required to file. EITC reduces the amount of tax you owe and may give you a refund. Many individuals with disabilities or persons with children with disabilities qualify for the Earned Income Tax Credit. The Earned Income Tax Credit is a pathway out of poverty for millions of Americans with disabilities.Difficulty of Care Federal Income Tax Exclusion There are tax exemptions for family members who are caregivers living in the same residence. If you take care of an adult who is living with you in your home, your pay is exempt from income tax! So, if a parent is taking care of an adult child, their pay is exempt from income taxes. Also, if you have someone living in your home who you take care of full time, your pay is also exempt!

IRS Notice 2014-7 Excludable Income – When a direct care worker (receiving Medicaid based Personal Care Attendant payments) lives with the participant that they provide services to, their income may be excluded from Federal Income Tax. In order to qualify for the exclusion they must be able to answer YES to all the statements below:

– I provide services to the individual participant in my home. (It doesn’t matter who owns or rents the home.)
– I do not have a separate home where I reside.
– This is the home where I reside and regularly perform the routines of private life, including shared meals and holidays with family.

Note: Does not apply to Act 150 program participants.

Volunteer Income Tax Assistance Program (VITA) VITA is for people with low income, people with disabilities, seniors, and others who need special help. Haven’t completed your taxes yet? You may be eligible for free assistance with filing your taxes and applying for the Earned Income Tax Credit. VITA volunteers are certified and trained by the Internal Revenue Service and can help you prepare a basic return. In addition to VITA, the Tax Counseling for the Elderly (TCE) program offers free tax help for all taxpayers, particularly those who are 60 years of age and older, specializing in questions about pensions and retirement-related issues unique to seniors. The IRS-certified volunteers who provide tax counseling are often retired individuals associated with non-profit organizations that receive grants from the IRS.

Senior and Disabled Tax Relief ProgramsElderly Citizens and Disabled Persons who meet certain criteria may be granted relief from all or part of their real estate taxes, personal property tax on one vehicle, the vehicle registration/license fee, and the solid waste fee. Eligibility criteria may change from year to year. Each locality has it’s own program, so research the guidelines in your city or county as they may vary.
Fiscal Agents (Attendant Payroll)
1 MCO (Magellan) and FFS Waivers have switched fiscal agents for the Medicaid waiver-funded Home and Community Based Services (HCBS) programs. Fiscal agents manage payroll and taxes for Personal Care Attendants.

It’s important for you to know which fiscal agent you use. Please make sure your Moms In Motion Service Facilitator knows which fiscal agent you are using. Tips: 

A backup caregiver is someone who is NOT the primary caregiver and NOT the attendant. “Backup caregiver” means the secondary person who will assume the role of providing direct care to and support of the waiver individual in instances of emergencies and in the absence of the primary caregiver who is unable to care for the individual. Failure to identify a backup person/caregiver could result in termination of services.

Attendants with Consumer Direct Care Network (CDCN) may have gotten small deposits for FICA.

Attendants can not start working until authorizations are approved.

DMAS/Kepro are in charge of authorizations for Fee For Service (FFS). Moms In Motion does not authorize Personal Care hours. See CCC Plus Waiver Pre-authorization process chart.

MySupport Virginia – Access is ending for Anthem CCC+ members. Some of MySupport’s contracts will be coming to an end shortly. Members enrolled with Anthem’s CCC+ program will continue to have access to MySupport until February 1st. Members enrolled in the DD Waiver or HIPP programs will have access to MySupport until at least April 1st, with further decisions regarding the DD Waiver/HIPP population to come from the Department after that.

An Update From The Arc’s Center For Future Planning

The Arc’s Center for Future Planning is currently working on a project with The Arc of Massachusetts to learn more about the supports that people with I/DD need to make their own healthcare decisions. We recently held focus groups for self-advocates and health care professionals in Massachusetts to learn more about their experiences and recommendations. Special needs attorneys will also provide feedback. Based on feedback from these groups, The Arc plans to create materials that empower individuals with I/DD to manage their own healthcare. Waivers   MCO Fiscal Agent Changes
MCOs and Waivers will be switching fiscal agents for the Medicaid waiver-funded Home and Community Based Services (HCBS) programs. Fiscal agents manage payroll and taxes for Personal Care Attendants.    
Aetna is staying with PPL, though new clients in the Roanoke area will have the choice of PPL or CDCN. Magellan is going with ACES$. Anthem, Optima, Virginia Premier, and United Healthcare will stay with PPL.  
All individuals that have CL/FIS Waiver, HIPP & EPSDT with no Waiver will be switching to Consumer Direct Care Network (CDCN). Those on the CCC Plus Waiver and/or EPSDT with an MCO who are using Virginia Premier, Optima, Aetna*, Anthem, and United Healthcare will not be impacted by this change.  
* Newly enrolled Consumer Directed members in the Southwest and/or Roanoke area of the state using Aetna will have the option to select PPL or Consumer Direct Care Network (CDCN) after 1/1/19. There are no changes for existing Aetna members after 1/1/19.

If your MCO or Waiver is switching to Consumer Direct Care Network:
Consumer Direct Care Network (CDCN) must receive completed versions of these forms for all employers and attendants by 12/3/2018 so that pay continues as scheduled in January. Employers and attendants must complete new forms so that CDCN can provide payroll services to attendants.

What forms are required? – Download the Employer Transition Packet, complete and submit a packet for all Individuals receiving services that you represent. Download the Attendant Transition Packet, complete and submit a packet for all of the attendants providing services to the individual.
Please submit complete and signed forms to InfoCDVA@ConsumerDirectCare.com or fax them to (877) 747-7764. Forms must be received by CDCN by 12/3/2018 so that attendant pay continues as scheduled in January. CDCN has extended their packet deadline for Employers on DMAS’ fee-for-service program from 12/3/18 to 12/10/18.

PPL will not process any Employee Of Record (EOR) changes or attendant hiring packets after 12/2/2018 for any recipients impacted by these changes. If you need to change your EOR or hire a new attendant after this date, please contact Consumer Direct Care Network. Without the DMAS-7 from the doctor there may be a delay in approval of authorizations and/or attendants may not be paid on time. It is important for parents to advocate to their doctor what supports their child needs, so no attendant hours are lost.   Three New Services Added to the Developmental Disabilities Waivers
Effective September 1, 2018, three new services are available under the Developmental Disabilities Medicaid Waiver program as stated in a Medicaid Memo. These new services can be utilized on the three types of DD Waiver which are, Building Independence (BI), Family and Individual Supports (FIS) and Community Living (CL). The new services are: Community Guide There are two categories of Community Guides, General Community Guide and The Housing Guide. Community Guide Services include direct assistance to promote an individuals’ self-determination through using community resources that lead to connection to and independent participation in integrated, independent housing or community activities. Housing supports will assist an individual move to independent housing by helping with transition and tenancy sustaining activities. The community housing guide will collaborate with the support coordinator, regional housing specialist, and others to enable the individual achieve and sustain integrated, independent living.   Peer Mentoring Peer Mentor Supports provide information, resources, guidance, and support from an experienced, trained peer mentor to an individual receiving any of the three DD Waivers. Peer mentoring is delivered by individuals with developmental disabilities who are or have received services, and have shared experiences with the individual. Peer mentors will provide support and guidance. The service is designed to foster connections and relationships which build individual resilience. Peer mentors will share their successful strategies and experiences in navigating a broad range of community resources with individuals. Peer Mentor Supports may be authorized for up to six (6) consecutive months, and the cumulative total across that time frame may be no more than 60 hours in a plan year.   Benefits Planning Benefits planning is an individualized analysis and consultation service provided to assist individuals receiving DD Waiver services and Social Security benefits (SSI, SSDI, SSI/SSDI) to understand their benefits and explore the possibility of work, to start work, and the effect of work on local, state, and federal benefits. This service includes education and analysis about current benefits status and implementation and management of state and federal work incentives. This service results in the development of written resource documents to assist individuals and their families/legal representatives to better understand the current and future benefits of employment. This Benefits Planning service also provides information and education to working individuals to make successful transition to financial independence. The Virginia Low Income Home Energy Assistance Program assists low-income households, particularly those with the lowest incomes that pay a high portion of household income for home energy. Virginia and you must need financial assistance for home energy costs. A person who participates or has family members who participate in certain other benefit programs, such as the

automatically eligible for this benefit.

Coverage will begin January 1, 2019 for those who apply and are able to enroll for Virginia’s New Health Coverage for Adults. Applications have been accepted since November 1, 2018. Now thousands of Virginians aged 19-64 will be able to apply for low or no-cost health coverage so they don’t have to worry about getting sick or having an accident!

In September, The U.S. Department of Housing and Urban Development (HUD) issued a Notice of Funding Availability (NOFA) for the Section 811 Mainstream Housing Choice Voucher Program which impacts non-elderly persons with disabilities.

The Department of Housing and Urban Development (HUD) awarded $98.5 million to 285 public housing authorities across the U.S. to provide new, permanent affordable housing vouchers to nearly 12,000 non-elderly people with disabilities. The housing assistance is provided through HUD’s Section 811 Mainstream Housing Choice Voucher Program which provides funding to housing agencies to assist non-elderly people with disabilities who are: transitioning out of institutional or other separated settings; at serious risk of institutionalization; homeless; or at risk of becoming homeless. This program helps to further the goals of the Americans with Disabilities Act by helping persons with disabilities live in the most integrated setting. The program also encourages partnerships with health and human service agencies with a demonstrated capacity to coordinate voluntary services and supports to enable individuals to live independently in the community. 2018 Awarded Housing Vouchers Listed by State Related News Article from November 12, 2018: A ‘game changer’ Proposed Medicaid benefit would cover housing services   The VT Autism Clinic and Center for Autism Research’s Mobile Autism Clinic   The Center’s newest outreach initiative is housed in a 29-foot RV that will expand more Autism services into several counties within Central Appalachia. The mission of the Virginia Tech Autism Clinic/Center for Autism Research/Mobile Autism Clinic (VTAC/CAR/MAC) is to merge science with service. The MAC will be equipped with computers, internet access, and video recording equipment, and will offer space to conduct parent/family mediated interventions for Autism. Regular visits to these communities by Center faculty and staff in the MAC will provide parents and caregivers with trainings on evidence-based treatment, with the goal being to empower families with additional skills on how to better support their children with Autism. The MAC focuses specifically on under-served areas of rural Appalachia in further Southwest Virginia. The Mobile Autism Clinic alternates locations on Friday afternoons, spending one in Galax, Virginia and the other in Marion, Virginia.  Overview of MAC services: Treatment services for Autism Spectrum Disorder are based on a variety of empirically supported intervention techniques. All services are provided by graduate student clinicians in the Department of Psychology at Virginia Tech, supervised by a licensed clinical psychologist. Individualized treatment approaches are developed for each child/family based on evidence-based behavioral strategies from Applied Behavior Analysis, developmental approaches, and Pivotal Response Treatment.  Some common themes clinicians work on are social skills, challenging behaviors, managing anxiety, stress and/or anger management and various parent trainings. They are now offering diagnostic evaluations for those who are suspected to have Autism Spectrum Disorder.   Treatment Sessions in the MAC: The initial session is an hour and a half intake with parent/caregiver(s) and child.  Future appointments may be for the parent/caregiver only or may include the child, depending on needs of the family and goals that have been discussed with the clinician. They currently use a therapy/consultation model where we will meet with the family (parent/caregiver and/or child) in-person once per month for therapy/training sessions and then continue the discussion via pre-arranged phone/Skype consultation meetings in between the MAC visits. The goal is to empower caregivers/parents with skills they can use for the long term at home. Each family session is currently $15, and less for phone consultation meetings. Parent/caregiver needs to bring documentation, evaluations, etc. to the initial intake appointment.  Diagnostic Evaluations in the MAC: Diagnostic evaluations/assessments for Autism Spectrum Disorder range from 3 to 9 hours, depending on what is requested or needed. They use gold-standard evidence-based tools for conducting diagnostic evaluations. Fees for diagnostic evaluations/assessments are determined on a sliding scale, based on family income. The VT Autism Clinic and Center for Autism Research look forward to hosting their Annual Autism Conference on Friday, April 26, 2019 in Blacksburg at the Inn at Virginia Tech.   Virginia Birth-Related Neurological Injury Compensation Program
Babies can be born with serious birth-related neurological injuries. The Virginia Birth-Related Neurological Injury Compensation Program helps parents take care of these children for life. This program is designed to assure access to obstetrical services for all Virginia residents. The program covers what insurance and other programs don’t. Expenses such as medical expenses, hospital expenses, rehabilitation expenses, in-home nursing care and much more. With soaring medical malpractice insurance rates, insurance companies are on the brink of eliminating coverage. Virginia has worked with all stakeholders, including physicians, associations, insurers, lawyers and others to develop an innovative solution, the Virginia Birth-Related Neurological Injury Compensation Program.   The Program was a first of its kind nationally. Located in Richmond, a nine-member volunteer board of directors governs the organization. The Governor of Virginia appoints all board members. Although started by the Virginia General Assembly, the Birth-Injury Program is an independent organization. A respite caregiver is a person who takes over when the primary caregiver takes a break. As a parent raising a child with a disability, you might find that “me time” is more fantasy than reality. Sure, you’d love some time to yourself, or one-on-one time with a spouse, partner, friend, or another child. When your child has special needs, handing over responsibility can be a real challenge. You might feel as if you are the only person who can do the job, and doubt that anyone else could meet all of your child’s needs. But remember, you’re not superhuman. There’s only so much you can give before you will feel mentally, emotionally, and physically drained. When you take time off to recharge, you’ll be able to give more and enjoy doing it. …Your child will benefit too! Respite care provides parents and other caregivers with short-term personal care services that offer temporary relief, improve family stability, and reduce the risk of abuse or neglect. Hire Autism is a non-profit in Northern Virginia that helps people ages 16 and up on the autism spectrum to get placed into the work place. Hire Autism is a pilot program of the Organization for Autism Research (OAR). Started in 2017, the Hire Autism program helps individuals find jobs that match their interests and skills by offering an autism-friendly application process that showcases their strengths to employers who are looking to be matched with quality candidates. Hire Autism provides individualized support to job seekers, such as resume building, cover letter writing, interview practice, customized job recommendations. They also maintain an active job database and keeps contact with potential employers. Hire Autism is proud to cultivate relationships with employers as well as educating them on Autism and best practices for managing and working with individuals on the autism spectrum!   More resources:

Community Coach Program is a service on all three DD Waivers that provides one-on-one by a community coach to an individual in an integrated employment or self-employment situation at or above minimum wage in a job that meets personal and career goals. A coach will assist with the job search and job application process. Once hired, the coach helps help train job duties until the individual is able to do the tasks independently or if appropriate, will provide constant coaching, instruction and monitoring. The coach’s job is to report to Medicaid and develop the skills of the individual for success at the work place.

Blog with videos, etc, to explain to another what an attendant is and highlight characteristics of a top quality attendant.   The Arc of Northern Virginia has put together an incredible document to introduce individuals to consumer direction. Starting on page 8 of the document, there are very valuable insights into finding and managing qualified care providers. (Remember they are located in Northern Virginia so the reimbursement rate is only relevant to Northern Virginia.)    Other strategies to find attendants: Relevant departments of local colleges. (OT, PT, etc) Local Department of Social Services and Centers for Independent Living likely has a list of people interested in working as attendants. Ask your school’s paraprofessionals.
